Annual Melissa Edwards 5k Raises Money for Womelsdorf Community Library

On Saturday, April 23rd, Gregg and Richard Freeburn attended the Melissa Edwards 8th Annual 5k Memorial Run/Walk.  The annual event raises money for the Womelsdorf Community Library in honor of Melissa Edwards, a former library volunteer.

Melissa died tragically in a car accident on March 19, 2008.  At the time of her death, Melissa was a Junior at Conrad Weiser High School, where she was a member of the Art club, and was an honor student.  Melissa loved books and was an avid reader.  She also loved serving as an volunteer at the Womelsdorf Community Library, participating in everything from Puppet Shows, to Storytime, to an Art Auction and a 5K Fun Run.

Here Is Why You Should Always Read Your Contract.

IS THE WAIVER OF LIABILITY CLAUSE ON THE BACK OF A GYM MEMBERSHIP CONTRACT VALID?

Yes, says the Pennsylvania Superior Court in a case involving a written and signed contract for a Gold’s Gym membership.  In a recent 7 to 2 en banc decision, the Pennsylvania Superior Court upheld a waiver of liability clause on the back of a Gold’s Gym membership contract that Melinda Hinkal signed without reading.  Hinkal alleged in her lawsuit that she required two surgeries to correct a ruptured disc in her neck that she suffered during a session with a personal trainer at the gym.  A Union County Court of Common Pleas Judge threw the case out in January 2014, finding that Hinkal had assumed the risk of her injury by signing the waiver language on the back page of her membership contract.  On appeal, Hinkal argued that the Gold’s Gym waiver was invalid because of its location on the back of the membership contract.  She equated it to a waiver that was printed on the back of a tubing ticket that the Superior Court rejected in a 2006 case.  However, the majority of the court found that unlike the waiver in the tubing case, the Gold’s Gym membership contract contained a clear directive not to sign until reading both sides, and a straightforward statement that the contract constituted the entire agreement between the parties.  In addition, the Gold’s Gym membership contract contained a written acknowledgement that its terms were read and accepted before using the facility, and was signed by Hinkal.

What is the message here?  The court did not alter its position in the case involving the tubing waiver, but showed that it will uphold waivers if done properly.  What is the lesson?  Read before you sign.

Stay Safe on Your Motorcycle

In response to the many recent motorcycle motorcycleaccidents in the area, we wanted to remind you of these safety tips.

On May 10th, a woman was killed when the accused drunk-driver of the motorcycle she was riding on crashed into a concrete barrier.

On June 7th, a woman was killed and her husband seriously injured when their motorcycle collided with an SUV.

On June 26th, a man was killed when he struck a guardrail and was thrown from his motorcycle without a helmet.

On June 29th, a man was killed when he lost control of his motorcycle and hit a truck.

The above incidents are just a few of the accidents in the recent news, it has been a deadly few months for motorcyclists in Central PA.

Although motorcycles only made up 3% of all registered vehicles in 2013, they accounted for 14% of traffic fatalities. National Highway Traffic Safety Administration (NHTSA) reported that 4,668 motorcyclists were killed and an estimated 88,000 motorcyclists were injured in 2013. These numbers are slightly less than 2012.

In 2013, Pennsylvania had 182 motorcyclist fatalities. Most of these motorcyclists were not wearing helmets. The NHTSA estimates that helmets saved 1,630 lives in 2013, and that 715 more could have been saved if all motorcyclists had worn helmets.

According to the NHTSA, motorcyclist fatalities occur 26 times more frequently than passenger car occupant fatalities in traffic crashes. Freeburn Law is pleased to announce that we will be adding another full-time staff member to our team. Ashley Bloss has been working part-time for Freeburn Law for the past 3 years. This month, she joins our staff full-time as an Assistant to the Workers Compensation Department. She lives in York County with her husband, Justin, and their 3 children, Whitney, JB, and Molly. Ashley enjoys gardening, spending time with her family, and attending her children's activities. She was the president of the PTO at her children's school for 5 years and remains an active member of the school district.
